Terms of Service

Welcome to Allen Zhong. These Terms of Service ("Terms") govern your access to and use of our software-as-a-service platform ("Service") provided by Allen Zhong ("Company," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you are agreeing to these Terms on behalf of that organization and confirming that you have the authority to bind that organization to these Terms.

2. Account Registration and Use

To use the Service, you must register for an account. When you register:

  • You must provide accurate, current, and complete information during the registration process.
  • You must maintain the security of your account credentials and not share them with others.
  • You are responsible for all activities that occur under your account.
  • You must promptly notify us if you discover or suspect any unauthorized use of your account.
  • You must be at least 18 years old to create an account and use the Service.

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or if your account is being used in a manner that could harm the Service or other users.

3. Subscription and Payment

The Service is offered on a subscription basis. You agree to pay the fees associated with your chosen subscription plan. Payment terms include:

  • All fees are charged in U.S. dollars and are non-refundable except as expressly stated in our Refund Policy.
  • Subscriptions are billed either monthly or annually, depending on your selected plan.
  • Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • We may change our pricing at any time, but price changes will not affect your current subscription until the next renewal period.
  • Payments are processed through our payment processor, Paddle.com Market Ltd ("Paddle"). Paddle is the Merchant of Record for all purchases.

4. Free Trial

We offer a 14-day free trial for new users. During the free trial period, you will have access to the features included in your selected plan. No payment is required to start the free trial. At the end of the free trial, your account will be suspended unless you choose to subscribe to a paid plan. Your data will be retained for 30 days after the trial ends.

5. Refund Policy

We offer a 14-day unconditional refund policy for first-time subscribers. If you are not satisfied with the Service within the first 14 days of your paid subscription, you may request a full refund by contacting us at zhong0709001@163.com. 6. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to violate any applicable laws or regulations.
  • Use the Service to infringe on the intellectual property rights of others.
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.
  • Use the Service to transmit malicious code, viruses, or harmful content.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to engage in any activity that is harmful, offensive, or discriminatory.
  • Create multiple accounts to circumvent any limitations or restrictions.

7. Intellectual Property

The Service and all content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Allen Zhong and are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute any part of the Service without our prior written consent.
  • Use our trademarks, logos, or branding without permission.
  • Create derivative works based on the Service.
  • Reverse engineer, decompile, or disassemble any software provided as part of the Service.

You retain ownership of all data you input into the Service, including customer information, work orders, and invoices. By using the Service, you grant us a limited license to process and store your data solely for the purpose of providing the Service.

8. Data Security and Backup

We implement reasonable security measures to protect your data. However, no method of transmission over the internet or electronic storage is completely secure. You are responsible for maintaining backup copies of your critical data. We are not liable for any loss or corruption of your data.

9. Service Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue the Service or any feature at any time without prior notice. We may also impose limits on certain features or restrict access to parts of the Service. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLEN ZHONG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Allen Zhong and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and, where appropriate, sending you an email notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue your use of the Service.

15. Termination

You may terminate your account and subscription at any time by contacting us at zhong0709001@163.com or through your account settings. Upon termination:

  • Your access to the Service will cease immediately.
  • We will delete your account data within 30 days, unless legally required to retain it.
  • No refunds will be provided for partial subscription periods, except as stated in our Refund Policy.

We may terminate or suspend your account at any time for any reason, including violation of these Terms, without prior notice or liability.
